Membership Meeting | Beneficiary Deemed Owner Trusts (BDOTs)
Program Description and Benefits:
Why does everyone think it’s malpractice not to use grantor trusts, but then ignore the ability to keep trusts taxed directly to individuals after a grantor’s death under Code Section 678? BDOTs are often much more income tax efficient for lower-middle income families (by avoiding higher compressed tax brackets and loss of certain tax benefits endemic to non-grantor trusts) but equally advantageous for the uber-wealthy (who want their GST exempt trusts to grow tax-free). Moreover, the asset protection for such trusts, while seemingly deficient at first glance, can actually be far superior over time v. ordinary non-grantor trusts. We’ll learn the pros and cons of such trusts and when they best fit a client’s estate plan.
